UK Points-based system visas – Tier 2 changes to be introduced

On the 11th September the UK Border Agency (UKBA) announced that it would be introducing recommendations made by MAC (Migration Advisory Committee) that will tighten up the rules controlling when skilled workers are allowed to take jobs in the UK under the Points-Based System.

The following changes will be implemented from 2010:

· All positions are to be advertised to British workers in Jobcentre Plus for 4 weeks before companies can seek to employ non-EU individuals.
· The qualifying period for individuals wishing to transfer to work at their company’s UK base has been extended. Workers will be required to work for a minimum of 1 year instead of the current 6 month period.
· The minimum salary that will allow an individual to qualify as a skilled worker will rise from £17,000 to £20,000.
