Changes to British Citizenship
13th January, 2010
Changes to British nationality law introduced by the Borders, Citizenship and Immigration Act 2009 came into force on the 13th January. The changes that have been brought in are for registration requirements.
The most relevant changes to Smooth clients as of the 13 January onwards are detailed below:
Children born outside of the UK to British citizens by descent
As long as they apply before their 18th birthday, a child of a British Citizen born outside of the UK may register under section 3(2) of the British Nationality Act 1981 for British Citizenship.
Children of British mothers
Section 4C of the British Nationality Act 1981 has been extended to allow a person born to a British mother who was born before 1961 the right to register as a British citizen. Previously the right was only for a person born after 7 February 1961.
